Delaware Law On Resisting Arrest

Depending on the circumstances of your arrest, resisting arrest can be either a misdemeanor or a felony. Typically, if you run away from the police officer who is attempting to arrest you, that is a misdemeanor. If, however, you use force against the police officer, that could lead to felony charges. That is the case even if the officer is uninjured.

The penalties for a felony versus a misdemeanor vary. For a misdemeanor, you could be facing as little as 30 days in jail and a fine of up to $575. However, a felony conviction could mean you face 15 years in prison and a bail set between $5,000-$20,000. You need a lawyer to protect you from serious penalties for your crime.
